Contractor Teaming Agreement Far

Team agreements can be a valuable tool for small businesses, allowing companies to pool resources, management skills and technical knowledge. All of these elements contribute to making a small business more competitive in the tendering process. However, if this is not the case, the application of team agreements can have a negative impact on their ability to meet the size standards of land freeze contracts. Here at SmallGovCon, my colleagues and I often discuss team agreements and joint ventures. As important as the collaboration of many contractors is, one would think that the FAR would be overloaded with information on joint ventures and premium/subcontracting teams. Not like that. Most legal guidelines for joint ventures and teams are within the rules of the SBA. The FAR itself is much less detailed. FAR 9.601 contains this definition of a « Contractor Team Arrangement »: there are many different ways a GSA contractor can do business with the federal government. Federal authorities focus on getting global solutions, which is why companies often have to partner to get greater opportunities.

Let`s go back to the GAO demonstration. The protest, NextGen Consulting, Inc., B-413104.4 (November 16, 2016) included the « ramp on » call for the large CIO-SP3 CIO-SP3 large companies GWAC IDIQ. The invitation contained detailed instructions on ATCs.

In practical terms, the invitation provided that if a supplier wanted its teammates to be considered part of the evaluation process, the supplier`s team must be in the form prescribed by FAR 9.601 (1), i.e. in a joint venture or partnership.
